  • We do not guarantee that guides will work in all environments or configurations
  • You are responsible for testing and validating any code or configurations in your environment before production use
  • We are not liable for any issues arising from the use of our documentation or Open Source Content
  • Community contributions may not be verified or tested by us
  • Open source code may have dependencies that change over time

Important Notice for Production Use:

  • Always review and test code in non-production environments first
  • Maintain backups before applying infrastructure changes

7.3 Service Level

For professional services clients, we will use commercially reasonable efforts to meet agreed-upon timelines and deliverables. Specific service levels may be outlined in a separate service agreement.

8. Fees and Payment

8.1 Service Fees

Free Open Source Content: Our deployment guides, documentation, and open source code are available free of charge under the MIT License.

Professional Services: Our consulting, custom implementation, and support services are provided on a custom quotation basis. Fees vary depending on project scope, complexity, and requirements:

  • Custom Quotations: Fees are determined individually based on your specific requirements and project scope
  • Quotation Process: After discussing your needs, we will provide a detailed quotation outlining deliverables, timeline, and pricing
  • No Obligation: Receiving a quotation does not obligate you to proceed with the services
  • Currency: Fees may be quoted in Polish Złoty (PLN), EUR, or USD depending on the engagement
  • Binding Agreement: Fees become binding only upon acceptance of the quotation or execution of a service agreement
  • Non-refundable: Unless otherwise specified in your service agreement, fees are non-refundable except as required by law
  • Price Validity: Quoted prices are valid for 30 days from quotation date unless otherwise specified
  • Rate Changes: We reserve the right to change our standard rates, but quoted prices for accepted proposals remain fixed for the duration of that specific engagement
  • Payment Terms: Specific payment terms, milestones, and schedules will be outlined in your Statement of Work (SOW) or service agreement

8.2 Payment Terms

  • Payment is due according to the terms specified in your invoice or service agreement
  • Late payments may incur interest charges at the rate permitted by applicable law
  • We may suspend Services for non-payment after providing reasonable notice

8.3 Taxes

You are responsible for all applicable taxes, duties, and governmental charges (collectively, "Taxes") except for taxes based on our net income. If we are required to collect or pay Taxes, they will be invoiced to you.

Regarding infrastructure deployment, DevOps services, and Open Source Content:

  • Data Backup: You are responsible for backing up your data before any deployment
  • Testing: You are responsible for testing deployments in non-production environments
  • Data Loss: We are not responsible for data loss, downtime, or other issues resulting from deployments
  • Cloud Costs: Cloud infrastructure costs are your responsibility
  • Compliance: You are responsible for compliance with applicable laws and regulations in your jurisdiction
  • Open Source "AS IS": Open Source Content is provided without warranty under the terms of its license
  • Community Contributions: Code contributed by the community may not be reviewed or tested by us
  • Dependencies: Third-party dependencies in open source code may change or become unavailable
  • Security: You are responsible for security audits and vulnerability assessments of code used in production

11. Indemnification

For disputes where the amount in controversy is less than 10,000 PLN, either party may elect to resolve the dispute through binding arbitration in accordance with the rules of the Polish Arbitration Court. The arbitration shall be conducted in Polish or English, as mutually agreed.

14.4 Class Action Waiver

You agree to resolve disputes with us on an individual basis. You waive any right to bring claims against us as a plaintiff or class member in any class or representative action or proceeding.

14.5 Time Limit for Claims

Any cause of action or claim you may have arising out of or relating to these Terms or the Services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

15. General Provisions

These Terms, together with our Privacy Policy and any separate service agreements, constitute the entire agreement between you and us regarding the Services and supersede all prior agreements and understandings.
